Terms of Service

These Terms of Service govern your access to and use of Qmunidad. Please read them carefully before using the platform.

1. Acceptance of terms

By accessing or using Qmunidad ("the platform"), you agree to be bound by these Terms of Service. If you do not agree, do not use the platform.

These terms apply to all users including developers, HOA administrators, guards, and residents.

2. Description of service

Qmunidad is a village management platform for Philippine residential subdivisions. It provides tools for visitor logging, resident management, announcements, maintenance requests, and HOA administration.

The platform is offered as a subscription-based service (Software as a Service). Features are subject to change.

3. Accounts and access

·Developer accounts are created by Qmunidad upon subscription.
·HOA admin, guard, and resident accounts are created by the developer or HOA admin managing that village.
·You are responsible for maintaining the confidentiality of your account credentials.
·You must notify us immediately of any unauthorized use of your account.
·Accounts may not be shared between individuals.

4. Subscription and payment

·Qmunidad is sold as a subscription to village developers.
·Subscription fees are billed as agreed upon at the time of purchase.
·Subscriptions may be cancelled at any time. No refunds are issued for partial billing periods.
·Qmunidad reserves the right to change pricing with 30 days' notice.

5. Acceptable use

You agree not to:

·Use the platform for any unlawful purpose
·Attempt to access another village's data without authorization
·Upload malicious code, files, or content
·Reverse-engineer or copy the platform
·Resell or redistribute access to the platform without written permission

6. Data and ownership

Village data (resident records, visitor logs, announcements) belongs to the developer or HOA that controls that village. Qmunidad does not claim ownership of your data.

Upon cancellation, data is retained for 30 days before deletion. You may request an export before cancellation.

7. Village transfer

When a developer transfers a village to an HOA administrator, the HOA administrator becomes the data controller for that village. The developer retains read-only access. This action is permanent and cannot be reversed through the platform.

8. Availability and uptime

Qmunidad aims for high availability but does not guarantee uninterrupted service. Scheduled maintenance, infrastructure incidents, or force majeure events may cause downtime.

We are not liable for losses resulting from service interruptions.

9. Limitation of liability

To the maximum extent permitted by law, Qmunidad shall not be liable for any indirect, incidental, or consequential damages arising from your use of the platform, including but not limited to data loss, security incidents caused by user error, or service interruption.

Our total liability in any case shall not exceed the amount paid by you in the 12 months preceding the claim.

10. Termination

We reserve the right to suspend or terminate accounts that violate these terms, without prior notice.

You may terminate your subscription at any time by contacting us. Termination does not entitle you to a refund.

11. Governing law

These Terms of Service are governed by the laws of the Republic of the Philippines. Any disputes shall be resolved in the appropriate courts of the Philippines.

12. Changes to terms

We may update these terms at any time. Changes will be posted on this page. Continued use of the platform after changes constitutes acceptance of the updated terms.
